256", "Home 512" & "Home 1024" combined
will be entitled to a full redemption of their line rental charges
inclusive of the VAT on the 6th and 12th month of their contract.
The following criteria must be adhered to:
All charges relating to your ADSL line have been paid in full
and on time.
A copy of the 6th & 12th months bill is returned to us
within 28 days of the beginning of the 6th & 12th month
respectively.
Each 256th subscriber will be informed of their redemption 5
months into each contract via their selected eweb.co.uk email
address as chosen when signing up.
A cheque made payable to the subscriber will be issued within
7 days of receiving a copy of your requested bill and sent to
your address as registered during signup.
GENERAL
1 Introduction
These Terms and Conditions set forth the Registration Agreement
between you and eweb.co.uk (a trading company of iXus industries
limited), a South Wales based Company. In this Agreement eweb.co.uk
shall be referred to as "The Registrar", "we",
"us" and you shall be referred to as "The Customer",
"you" or "your".
eweb.co.uk is a Nominet (www.nominet.org.uk) Member and operates
as a supplier of domain names to the Internet community. By registering
a domain name through us, whether for your own use or as an agent
or person who uses us to register domains on behalf of a third
party, you agree to accept the Terms and Conditions set forth
in this agreement and act as our agent solely so as to incorporate
the same in any agreement with any such third party so that such
third party is bound by the same.
This policy applies to you if you are a customer or user of eweb.co.uk
hosted WWW space. It is intended to ensure that your use of our
service is trouble free and that you have due regard to the law
and the needs of other users.
Please read it carefully. It is a condition of your use of our
service that you comply with the terms of this policy.
This policy may be amended by eweb.co.uk at any time and you
are therefore advised to frequently visit this page. Users will
be emailed if there are any significant changes or additions to
this document.
1. Some general principles
1.1 eweb.co.uk is not responsible for the content of user originated
traffic
We exercise no direct supervision or control whatsoever over the
content of the information passing through our network.
We do not assume any responsibility for information not sent
or authorised by us.
The responsibility for traffic that does not conform with this
policy and all possible consequences lie with the sender of the
traffic.
1.2 You are responsible for use of your account
If you permit others to use our service, you are responsible for
making users of the service aware of this policy and obtaining
compliance of your users with this policy.
1.3 You are responsible for complying with conditions of use
of other networks
If we provide you with access to a network outside our service
you must comply with any acceptable use conditions which apply
to that network.
2. Acceptable uses
2.1 You have responsibilities
It is your responsibility to:
Use our service and services in a manner which does not violate
any applicable laws or regulations;
Respect the conventions of the newsgroups, lists and networks
that you use;
Respect the legal protection afforded by copyright, trade marks,
license rights and other laws to materials accessible via our
service;
Respect the privacy of others.
Use the service in a manner, which does not interfere with or
disrupt other network users, services or equipment; and refrain
from acts that waste resources or prevent other users from receiving
the full benefit of our services.
2.2 Use must be ethical
Your use of our services must be ethical and in accordance with
accepted community standards.
3. Unacceptable uses
3.1 You must comply with the Law
It is not acceptable to use our service for any purpose that violates
local, national or international laws.
3.2 Specific kinds of use are not allowed
It is not acceptable to use our service to, amongst other things:
Violate copyright or other intellectual property rights;
Illegally store, use or distribute software;
Transmit threatening, obscene or offensive materials;
Engage in electronic 'stalking' or other forms of harassment
such as using abusive or aggressive language;
Misrepresent or defame others;
Commit fraud;
Gain unauthorised access to any computing, information, or communications
devices or resources, including but not limited to any machines
accessible via the Internet;
Damage, modify or destroy files, data, passwords, devices or
resources of eweb.co.uk, other users or third parties;
Engage in misleading or deceptive on-line marketing practices;
Conduct any business or activity or solicit the performance of
any activity that is prohibited by law;
Make an unauthorised transmission of confidential information
or material protected by trade secrets; or attempt to do any of
these things.
3.3 Disruption of the network is not allowed
You may not use the service to interfere with or disrupt other
network users, services or equipment. For example, you must not:
Distribute messages to inappropriate or unrelated forums, newsgroups
or mailing lists ('spamming');
Send unsolicited commercial messages;
Propagate computer worms, viruses or other types of malicious
programs;
Make transmissions of any type or quantity which adversely affect
our operation or jeopardise the use of our service, or its performance
for other subscribers; and
Harass or impersonate the staff or users of eweb.co.uk.
3.4 Soliciting subscribers to other services in not allowed
It is also not acceptable to use our service to solicit subscribers
to become subscribers of other competitive information services.
3.5 Resale of our services is not allowed
Resale of our services to others is forbidden unless expressly
permitted in writing.
4. What we may do to ensure that this policy is being
followed
4.1 We may monitor your account but will respect your privacy
If we have cause, we may monitor the conduct of your account to
determine whether this policy is being followed. If we monitor
the conduct of your account we will safeguard your privacy unless
to do so would involve us in concealment of a criminal offence
or inhibit the enforcement of this policy.
4.2 We will make an effort to contact you
If we become concerned that your use of our service may break
the law or that you have not complied with this policy we will
attempt to contact you before taking action.
4.3 We may terminate your account and/or notify the authorities
If we believe that your use of our service may break the law or
that you have not complied with this policy, we may:
Warn you by email;
Suspend your access to the service;
Terminate your account without notice; and/or
Notify and provide relevant information to the authorities, as
appears appropriate in the circumstances. At this point, we reserve
the right to delete any or all of your information, material,
software or other content stored on our system at our sole discretion.
4.4 We will re-establish services if resolution is achieved
If you do not repeatedly breach this policy, we do not regard
an instance of conduct causing our intervention as dangerous or
serious and the cause of our intervention is addressed and resolved,
we will promptly re-establish your service.
5. Removal of Email addresses
In the event that an email account has not been checked in the
past 90 days, we reserve the right to delete this email address.
All email waiting for collection in this mailbox will also be
deleted and new or existing customers will offer the address for
reuse. No compensation will be offered to customers who have their
email account removed under these, or any other circumstances.
6. Acceptable use of hosted WWW space
Please be aware of the following policy related to the use of
hosted WWW space through eweb.co.uk.
It is only available to customers of eweb.co.uk and cannot be
used to financially benefit a third party that is not a subscriber
of our service;
Commercial use of this space is permitted;
All use of this space is subject to all other policy listed in
this document;
CGI scripts are supported as well as php, perl, asp and many
other relevant support tools ;
No support with be offered for the development or uploading of
pages to this space, except where a fault is concerned;
Web statistics will be made available for your site on request;
You are responsible for keeping copies of your own data. eweb.co.uk
will not keep backups of these pages;
We accept no responsibility for loss of data, information in
any form or other matters whatsoever which result from the use
of this service;
We accept no responsibility for hit counts being reset or incorrect;
You are responsible for the content of your site, including obtaining
the legal permission for any works they include and ensuring that
the content of these pages does not violate UK or international
law.;
If you have not paid for your webspace after the annual deadline
we remove the contents of your site without notice;
eweb.co.uk reserves the right to remove any material from your
WWW space at our sole discretion, without prior notice;
eweb.co.uk reserves the right to suspend any or all of the hosted
WWW space services at any time, without prior notices;
You must not refer to your pages by any means other that the
address it is registered with. Specifically, you must not reference
or cause your WWW space to be referenced by dotted IP addresses.
7 Payment
eweb.co.uk will inform you of any price change in our services
by way of notice on our site in the hosting area. This would be
in your interests to make sure you are informed of any change
of our policy and or price changes in our service structure.
eweb.co.uk will after 30 days of Non-payment charge you a monthly
fee of 6% of the amount outstanding and will terminate your service
after a further 2 weeks of non-payment. We reserve the right to
install a page with Withheld due to Non-payment.
You will not be informed of the payment amount via Mail but in
electronic format, which you may print out and return immediately,
with payment when receiving this email.
8 Cancellation
Should you decide to leave us within the first year we must charge
for the changeover work involved this is defined as the "Admin
Charge". This is with in the first year of registration with
a dot com. and with in 2 years of a co.uk domain. The price is
£25.00 Stg plus vat per domain and will be paid prior to
any release being allowed. We reserve the right to maintain it
and charge you for the hosting facility over the contractual time
given in this policy. Which is £50.00 per domain for hosting
and 5.99 per year for the co.uk domains and 10.99 for the .com
domains based per year.
If you still decide to cancel you may pay either by credit card
or cheque cleared funds only with a headed letter of request either
faxed or posted to us asking for transfer.
We reserve the right not to transfer the domain(s) should the
letter heading not be exact to the initial registrar details from
the time of initial registration.
9 Discretion
We reserve the right under any management decision to either hold
or withdraw your service due to Non-payment , Illegal activities,
or any nature that may deem to the Management as Inappropriate
to the very nature of our company eweb.co.uk.
